SMS Program Summary
Cursorlynk enables home care agencies to send automated SMS messages to caregiver applicants who have explicitly opted in via a job application form. Messages relate solely to employment and recruitment. See Section 5 for full terms.
By creating an account or using the Cursorlynk platform, you agree to be bound by these Terms of Service and our Privacy Policy. If you are accepting these terms on behalf of an organization, you represent that you have authority to do so.
If you do not agree to these terms, do not use Cursorlynk. We may update these terms from time to time. Continued use of the platform after updates take effect constitutes acceptance of the revised terms.
Cursorlynk is a software-as-a-service (SaaS) platform that helps home care agencies recruit, screen, and manage caregiver applicants. Core features include branded applicant intake forms, SMS-based automated quick screening, a pipeline management board, analytics reporting, and coordinator team management.
We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice for material changes.
You must provide accurate, complete, and current information when creating your account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
Notify us immediately of any unauthorized use at support@cursorlynk.com. We are not liable for losses caused by unauthorized use you fail to report.
Each account is licensed to a single home care agency. Sharing accounts across multiple organizations is not permitted.
You agree to use Cursorlynk only for lawful purposes and in accordance with these terms. You agree not to:

Cursorlynk provides SMS automation services that enable home care agencies to communicate with caregiver applicants about open positions and the employment screening process.
How Consent Is Obtained
Caregiver applicants submit job applications through agency-branded pages hosted by Cursorlynk. Each application page includes an explicit opt-in consent checkbox with the following disclosure (or equivalent language):
No caregiver applicant receives an automated SMS message unless they have explicitly checked this consent box and submitted the form. Consent records are retained by Cursorlynk on behalf of the agency.
What Messages Are Sent
Messages sent through Cursorlynk are strictly related to caregiver employment and recruitment, including:
Message Frequency
Message frequency varies based on the applicant's engagement with the screening process. Applicants typically receive between 2 and 10 messages per application cycle.
Rates
Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
Opt-Out
Recipients may opt out of all messages at any time by replying STOP to any message. Upon receiving STOP, Cursorlynk immediately flags the recipient as do-not-contact and no further automated messages are sent. Opt-outs are permanent unless the recipient explicitly re-opts in through a new application.

Recipients may reply HELP to any message to receive contact information for the sending agency and a reminder of opt-out instructions.
No Sharing of Mobile Numbers
We do not sell, rent, trade, or share mobile phone numbers collected through Cursorlynk with third parties for marketing purposes. Mobile numbers are used solely to deliver employment-related SMS messages on behalf of the agency that collected consent.
Compliance
All SMS messaging through Cursorlynk complies with the Telephone Consumer Protection Act (TCPA) and A2P 10DLC carrier registration requirements. Cursorlynk activates live SMS sending only after successful A2P 10DLC campaign registration with The Campaign Registry (TCR).
You retain ownership of all data you submit to Cursorlynk, including caregiver applicant records. By using Cursorlynk, you grant us a limited license to process and store this data to provide the service.
Our handling of personal data is governed by our Privacy Policy, which is incorporated into these terms by reference.
Cursorlynk offers subscription plans billed monthly or annually. All fees are stated in US dollars. By providing payment information, you authorize us to charge the applicable fees to your payment method.
Subscription fees are non-refundable except as required by law. If your payment fails, we may suspend your account until payment is resolved.
We may change subscription prices with 30 days' notice. Continued use after the price change takes effect constitutes acceptance of the new pricing.
Cursorlynk and its underlying technology, including software, algorithms, user interface design, and documentation, are owned by Kaizen Vibes LLC and protected by intellectual property laws.
We grant you a limited, non-exclusive, non-transferable license to use Cursorlynk for your internal business purposes during your subscription term. You retain all rights to your data.
Cursorlynk is provided "as is" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free from harmful components.
To the maximum extent permitted by law, Kaizen Vibes LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of Cursorlynk.
Our total liability for any claim shall not exceed the fees you paid to us in the 12 months preceding the claim.
You agree to indemnify and hold harmless Kaizen Vibes LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of Cursorlynk, your violation of these terms, or your infringement of any third-party rights.
Either party may terminate your account at any time. You may cancel by emailing support@cursorlynk.com or through your account settings.
We may suspend or terminate your account immediately if you violate these terms or engage in conduct that poses a risk to others or the platform.
Upon termination, we will retain your data for 90 days for export, after which it will be deleted per our Privacy Policy.
These terms are governed by the laws of the State of New Jersey, USA. Any dispute shall be resolved through binding arbitration in New Jersey, except that either party may seek injunctive relief in court for intellectual property violations.
You waive any right to a jury trial or to participate in a class action lawsuit related to Cursorlynk.
